It's 42 in a 30 for the course eligibility.

I got picked up doing 39 over an average speed the other week.

Have you EVER seen any signposts that states that average speed cameras are only active during working hours 🤔

Even at weekends in the middle of the night on an empty road big brother is watching you 👀

There are roadworks on M5 atm

Average speed camera zone

I travel early in the morning

Some are lit, some not

Most ppl fly by those unlit, but slow down for those lit.

Not sure WTF is going on tbh.

I stick below 55 all the way and not been done yet.

However my last fine was going through 50mph roadwork zone (at 70+MPH)) at 8am Sunday morning when no one was actually working.

If the signs are up, regardless of whether ppl are working, that's the speed limit.

I just don't risk it at all. Stick pretty much smack bang to the limit.

Wifey got done few years ago doing 33 in a 30 zone! I told her to appeal it but miss goody two shoes was all "oh, but I was breaking the speed limit so I should accept it"! Blah blah blah!

Have you tested this theory?

The registered keeper gets served with a notice to disclose who was driving.

Obviously giving false info is against the rules but it is also an offence in itself to not disclose.

No doubt there will be a whole grey area within this argument also. Has anybody got experience?

Equally, however, Section 172 Road Traffic Act 1978 is something of an inroad into this principle. The effect of that Section is that for certain road traffic offences (including infringing a speed camera) one is obliged to disclose who was driving your vehicle at the time of the alleged offence. Failure to do so can result in a separate offence.

The judges also pointed out that UK law made it clear that no offence has been committed if a car owner can prove that he or she did not know, and could not be expected to know, who was driving the vehicle.

About 10 years ago I got caught by a mobile van, got the letter through asking to disclose who was driving the car at the time.  I told them that because I was sharing the driving with another driver, I didn't know who was driving at the time of the offence.  They then sent out a second letter, with a black and white photo of the driver, which I responded again (within time limits) that I still couldn't tell who was driving.  They then provided me with a colour photo!!  And also pressed home that failure to disclose who was driving could end up with me in more trouble.  At this point I took legal advice, and I was told that the courts wouldn't touch it with a barge pole!!!

So I replied, again, politely and in time, stating that unfortunately I still couldn't tell who was driving.

Never heard anything more!!!!! Result!

I was thinking further about this and here is an 'out', as I see it:

Put two people you don't know (the faces of) on your insurance.

If you get a picture clearly of yourself driving then you're doomed as usual, but if there is ANY doubt, you can state that one of the other people must have been driving and since you cannot force them to tell you which one, you (and they!) are off the hook.

Better even to have two identical twins that you might actually know, on your insurance.
Again, if it's not clearly you driving then it might be one of them, but which one? Who knows and who cares.

I was driving with a friend the other day and noticed that most of the speed camera's on the North Circular in London had disappeared. Hooorah I thought. Only to then see a sign seconds later saying Average Speed with a picture of a camera.

Seems this is the way things are going now.

The government is going to make a lot of money very quickly very soon!

Yes they work at night
Yes they work when roadworks are not in operation
Yes they trigger at lower than you hope sometimes

Yes you can get prosecuted for failing to disclose the driver (even with extenuating circumstances!)
Yes I am genuinely confused how this happens when you are pretty aware of the cameras and the average

Ask me how I know?.......

You can use these b*****d things to your advantage sometimes tho. Make use of your average speed computer by zeroing it between each yellow vulture that way if it shows your average to be say 35 in a 60 , you can afford to speed up for a short time to anything you like!
